Three Time Limits
The 90-day / 60-day window
USCIS must receive your I-765 between 90 days before and 60 days after your program end date. ⚠️ A DHS rule (Federal Register 2026-14439) was set to shorten "60 days after" to "30 days after" and the F-1 grace period from 60 to 30 days starting September 15, 2026, but on September 14 a federal court in Massachusetts postponed its effective date and barred enforcement, so the 90/60-day window still applies. Filings outside the window are rejected.
File within 30 days of your DSO recommendation
After your DSO enters the OPT recommendation in SEVIS and prints a new I-20, you must file within 30 days, or the recommendation expires.
No more than 90 days of unemployment in total
You can be unemployed for at most 90 days in total during OPT; going over can end your F-1 status. With a STEM extension, the limit becomes 150 days in total across your whole OPT period — that is the total, not 150 days on top of the 90. Unemployment days start counting from your EAD start date, not your graduation date.
A 60-day grace period after it ends
After OPT expires there is a 60-day grace period to change status, transfer schools or leave the country. You can't work during this time, but you can use it to file for H-1B or another status.
Frequently Asked Questions
- Can I start working before I have my EAD card?
- No. You can start only on or after the start date on your EAD and once you actually have the card. Working early is unauthorized employment, with serious consequences.
- Do I have to report a job change during OPT?
- Yes. Employer changes must be updated within the required deadline through your school's DSO or the SEVP Portal. If you don't report in time, the days may be counted as unemployment.
- Does pre-completion OPT before graduation use up my time?
- Yes, but only within the same degree level. OPT used before graduation is subtracted from that level's 12-month total, with part-time counted at half. Time used during your bachelor's does not affect your master's allowance.
- My program has ended but my EAD isn't approved yet. Can I stay in the U.S.?
- If you filed on time and the application is still pending, you can generally stay in the U.S. and wait, but you can't work until the EAD takes effect.
