AC21 Job Portability Checker: Can You Change Jobs While Your I-485 Is Pending?
Once your I-485 has been pending for 180 days, section 106(c) of AC21 lets you change employers without hurting your green card application — as long as the new job is in the "same or similar" occupational classification as the job in the original I-140. Note that this rule applies only to employment-based first, second and third preference (EB-1/2/3).

Three Conditions
① I-485 pending for 180 days
Counted from the date USCIS received the I-485; at least 180 days must have passed. The Received Date on the receipt notice (I-797C) is the starting point.
② I-140 approved or approvable
Changing jobs requires the I-140 to be approved — the USCIS Policy Manual says it must be approved before the portability request is granted; one that is pending but is eventually approved also counts. Merely being "approvable when filed" is not enough to support an AC21 job change. If the employer withdraws the I-140 after it has been approved for 180 days, or after the I-485 has been pending for 180 days, 8 CFR 205.1(a)(3)(iii)(C) says the I-140 "remains valid" — what is preserved is not just the priority date but the whole approved petition.
③ New job is "same or similar"
USCIS looks at the occupational classification (usually by SOC code), job duties, skill requirements and pay level together, not just the job title. After changing jobs you must file I-485 Supplement J to confirm the new job offer.

- Are the 180 days counted from filing the I-485 or from I-140 approval?
- From the date USCIS received the I-485. The I-140 approval date doesn't matter for this.
- Does moving into a management role still count as "similar"?
- Moving from a technical role to a management role in the same field can be found similar — the USCIS Policy Manual says it considers normal career progression — but the continuity of duties and pay has to be looked at case by case.
- What happens if my old employer withdraws the I-140 after I leave?
- If the I-140 had been approved for 180 days, withdrawal generally does not affect the retained priority date or your AC21 portability. Before 180 days, the risk is higher.
